WiseBolt™ Terms of Service

Welcome to WiseBolt™ ("WiseBolt," "we," "our," or "us"), a service of Energy for Good, LLC. These Terms of Service ("Terms") govern your access to and use of our website, software, insider services, tools, reports, recommendations, communications, and any other products or services we provide (collectively, the "Services"). By accessing or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, you must stop using the Services immediately. You must be at least 18 years old to use the Services.

Our Service

WiseBolt™ helps users understand how their electricity usage habits affect their energy costs and environmental impact. We provide electricity usage analysis, forecasts, estimated bill comparisons, energy insights, and plan recommendations. Energy for Good, LLC dba WiseBolt™ is licensed or certified to provide energy broker, shopping, and advisory services in Texas. Our broker ID is BR220174.

Your Information

To provide the Services, WiseBolt™ may request information including your contact information, service address, meter information, energy provider account information, historical usage data, and related household or geographic information. We use this information to model usage, forecast electricity consumption, calculate estimated bills, estimate environmental impact, and identify electricity plans that may fit your usage.

WiseBolt™ may use your information to request historical energy consumption data from Smart Meter Texas as allowed by applicable rules and laws. By authorizing WiseBolt™, you permit us to request and access your electricity usage data from Smart Meter Texas for up to 12 months unless you revoke that authorization earlier. You may revoke authorization through the WiseBolt™ portal or the Smart Meter Texas portal.

WiseBolt™ may use third-party service providers and data providers to operate the Services, including hosting providers, analytics providers, email providers, electricity data services, property data services, and other vendors. Third-party data may be subject to additional terms from those providers.

You are responsible for providing accurate, current, and complete information. If the information you provide is inaccurate, incomplete, outdated, or misleading, WiseBolt™ may suspend or terminate your account, limit access to the Services, or decline to provide recommendations or enrollment support.

If you revoke data-sharing authorization or terminate your account, WiseBolt™ will stop accessing new usage data where reasonably practicable. Stored data may be deleted, de-identified, or retained as described in our Privacy Policy, including where retention is needed for backups, security, legal compliance, dispute resolution, fraud prevention, business records, or service integrity.

Usage Terms

WiseBolt™ grants you a personal, limited, non-exclusive, non-transferable, revocable right to access and use the Services only for your own lawful personal or household purposes and only in compliance with these Terms.

You may not scrape, copy, reproduce, redistribute, resell, sublicense, reverse engineer, interfere with, misuse, or attempt to extract data from the Services except as expressly allowed by WiseBolt™. You may not circumvent access controls, security measures, usage limits, or restrictions related to the Services or third-party data.

WiseBolt™ may modify, suspend, restrict, or discontinue any portion of the Services at any time. WiseBolt™ may suspend or terminate your account or access to the Services for violation of these Terms, suspected misuse, fraud, legal or regulatory concerns, operational needs, or other legitimate business reasons.

If you access WiseBolt™ services through an API or automated process, you agree to comply with all usage limits, technical restrictions, and third-party provider requirements. WiseBolt™ may modify, restrict, suspend, or terminate API access at any time.

Estimates, Recommendations, and No Guarantee of Savings

WiseBolt™ provides estimates, forecasts, comparisons, and recommendations based on available data, assumptions, models, provider information, usage history, rate information, and other inputs. These outputs are informational estimates only. Actual electricity usage, bills, savings, emissions impact, fees, taxes, market prices, plan availability, provider terms, and other results may differ.

WiseBolt™ does not guarantee that you will save money, lower your electricity bill, reduce your environmental impact, qualify for a specific plan, or receive any particular rate or offer. Electricity plans, provider terms, utility charges, regulatory charges, taxes, and promotional offers may change without notice.

WiseBolt™ is not responsible for the provision of electricity, the reliability of electric service, the performance of any retail electric provider, utility, transmission and distribution utility, or other third party, or the terms of any contract you enter into with an electricity provider.

Accuracy of Data

WiseBolt™ relies on data from users, Smart Meter Texas, electricity providers, utilities, public sources, third-party data providers, and internal models. We try to keep information accurate and useful, but we do not guarantee that all usage data, rates, charges, plan terms, provider details, emissions estimates, forecasts, or other information will be complete, current, error-free, or available at all times.

Fees, Offers, and Availability

WiseBolt™ may receive compensation from electricity providers, partners, or other third parties when users enroll in certain plans or use certain Services. Available plans, pricing, promotions, estimated savings, and eligibility may vary by location, usage, provider, credit requirements, meter type, utility territory, and other factors.

WiseBolt™ reserves the right, in its sole discretion and with or without prior notice, to limit, modify, or discontinue any product, service, plan display, promotion, coupon, referral, offer, or feature; to refuse or cancel any transaction; or to decline to provide Services to any user where legally permitted.

Intellectual Property and Trademarks

The Services, including all software, interfaces, designs, text, graphics, logos, icons, images, reports, charts, data compilations, content, workflows, models, trade dress, and other materials, are owned by WiseBolt™, Energy for Good, LLC, or our licensors and are protected by intellectual property and other laws.

WiseBolt™, wisebolt.com, the WiseBolt™ logo, and related names, logos, product names, service names, designs, and slogans are trademarks or service marks of Energy for Good, LLC. You may not use those marks without prior written permission from Energy for Good, LLC. Other company names, product names, logos, and trademarks appearing through the Services belong to their respective owners.

Indemnity

You agree to defend, indemnify, and hold harmless WiseBolt™, Energy for Good, LLC, and their subsidiaries, affiliates, licensors, vendors, managers, officers, directors, employees, contractors, and agents from and against any claims, damages, obligations, losses, liabilities, costs, debts, and expenses, including attorney’s fees, arising from: (i) your use of or access to the Services; (ii) your violation of these Terms; (iii) your violation of any law, rule, regulation, or third-party right; (iv) information, content, or data submitted through your account; (v) your misuse of third-party data; (vi) your willful misconduct; or (vii) another party’s access to or use of the Services through your account or credentials.

Disclaimer of Warranties; Limitation of Liability

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WISEBOLT™ DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND RELIABILITY.

WISEBOLT™ DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, CURRENT, COMPLETE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY DEFECTS OR ERRORS WILL BE CORRECTED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WISEBOLT™, ENERGY FOR GOOD, LLC, AND THEIR AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST SAVINGS, LOST DATA, SERVICE INTERRUPTIONS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WISEBOLT™’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID DIRECTLY TO WISEBOLT™ FOR THE SERVICES DURING THE 12 MONTHS BEFORE THE CLAIM AROSE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME LIMITATIONS MAY NOT APPLY TO YOU.

Governing Law

These Terms and any dispute arising out of or related to the Services are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Subject to the arbitration provision below, you agree to the exclusive jurisdiction and venue of the courts located in Fort Bend County, Texas.

Jury Trial Waiver

TO THE FULLEST EXTENT PERMITTED BY LAW, EACH PARTY KNOWINGLY, VOLUNTARILY, AND INTENTIONALLY WAIVES ANY RIGHT TO A TRIAL BY JURY IN ANY ACTION, CLAIM, OR PROCEEDING ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES.

Dispute Resolution — Arbitration; Class Action Waiver

The parties agree to resolve any dispute, claim, controversy, lawsuit, or proceeding arising out of or related to these Terms or the Services through binding arbitration administered by the American Arbitration Association under its applicable rules. The arbitration shall take place in Houston, Texas, unless the parties agree otherwise. The arbitration shall be conducted by one arbitrator.

Any arbitration shall be conducted only in your individual capacity and not as a plaintiff, class member, or representative in any purported class, collective, consolidated, or representative proceeding. Class arbitration, class actions, collective actions, and representative actions are not permitted.

Changes to These Terms

WiseBolt™ may modify these Terms from time to time. Modified Terms are effective when posted to the Services unless a later effective date is stated. If you have an account, we may also notify you of material changes through the Services or by email. Your continued use of the Services after modified Terms become effective means you accept the modified Terms.

User Communications

By providing your phone number, including a mobile number, and email address, you consent to receive communications from WiseBolt™ and parties acting on our behalf for non-marketing purposes, including account updates, service notices, usage reports, authorization notices, and transaction-related communications. These communications may be sent by telephone, text message, email, or other channels and may use automated technology where permitted by law. You may receive marketing emails and may opt out by using the unsubscribe or opt-out link in the email.

Notices

Unless otherwise required by law, WiseBolt™ may provide notices through the Services, by email, or by mail using the contact information you provide. You are responsible for keeping your contact information current.

General Terms

These Terms, together with any policies incorporated by reference, constitute the complete agreement between you and WiseBolt™ regarding the Services. If any provision is held unenforceable, that provision shall be modified only to the extent necessary to make it enforceable, and the remaining provisions will remain in effect. You may not assign these Terms or your rights or obligations without prior written consent from WiseBolt™. WiseBolt™ may assign these Terms without your consent.

Sections that by their nature should survive termination will survive, including sections related to intellectual property, trademarks, disclaimers, limitations of liability, indemnity, arbitration, class action waiver, governing law, and payment obligations.
